Sir James Innes of Innes, who succeeded to that baronetcy in 1764, was, in 1805, one of the claimants to the Roxburghe titles, being the male heir of the first Earl of Roxburghe, through his great-grandmother. The House of Lords finally decided in his favour in 1812, and it is thought that this painting dates from this date. He married a Mary Wray of a Lincolnshire family in 1769, who died childless in 1807. Eight days after her death, Sir James re-married to Harriet Charlewood of Windlesham in Surrey. By this time he liked to be known as Innes-Ker.
